Update on age discrimination following changes to the NHS Pension

 

The government have already excepted the outcome of the McCloud and Sergeant judgment (fire-fighters and judges case) and its application to all public sector pension schemes including the NHS scheme. A statement from the nhs Business service is here:-

NHS pension scheme members who have been discriminated against (due to age) will need to be compensated. At present there is no need for UNISON to lodge individual claims.

However, what the compensation will look like is still to be confirmed but will be framed by the outcome of the remedy hearings from McCloud and Sargeant.

It will be 2020 before UNISON know the direction of travel.

Unison (and other health unions) have a “letter of comfort” from the Department of Health that there will be a centralised scheme for sorting it all out and UNISON won’t have to put in individual claims to get members whatever they are due.
